3. ORDINANCE NO. 12-04 fka 11-30 LAND DEVELOPMENT CODE AMENDMENT FOR SEXUALLY ORIENTED BUSINESS

An Ordinance of Manatee County, Florida, regarding land development; amending Section 201, Land Development Code, to repeal all adult entertainment related definitions; repealing in its entirety Section 707, Land Development Code; creating a new section in the Land Development Code for sexually oriented business related definitions, in Section 201, Definitions; creating a new Section 707 in the Land Development Code consisting of sexually oriented business regulations; providing for a purpose and intent; providing for administration and enforcement of the sexually oriented business regulations; amending other sections of the Land Development Code for internal consistency; providing for severability; providing for codification and providing for an effective date.

 Luke Lirot, Attorney for the applicant, G T Management (DaVincis) requested Commissioners put-off making any decision on the ordinance. Lirot claimed it shouldn't even be a land use issue, that it fell under a different code. He also wanted the decision to be rescheduled to a date that would allow a after 5 pm time frame because many that wanted to speak couldn't make it during the day.   -- Approved, Unanimous (FULL STORY

4. ORDINANCE 12-07 fka 11-41 LAND DEVELOPMENT CODE TEXT AMENDMENT MASTER

PLANNED INSTITUTIONAL ZONING DISTRICT

An Ordinance of the Board of County Commissioners of Manatee County, Florida, regarding land development; amending the Manatee County Land Development Code to create a new zoning district – ”Master Planned – Institutional" (MP-I) – and amending the Land Development Code to effectuate that zoning district. 

The Master Planned Institutional District is established to provide for areas for institutional uses such as churches, schools, medical facilities, or other similar uses with multi pal buildings and/or facilities in a campus setting. The MP-I shall be similar to the General development Plan. The district is designed to allow future expansions and eventual build-out of master planned campuses while insuring compatibility with adjacent land uses. The permissible uses within the MP-I District shall be limited to the uses prescribed within such district.

Attorney Caleb Grimes, representing IMG Academies (the applicant) worked with Staff to prepare the code rewrite for the 111 acres in the MP-I. It was designed to allow flexibility for a broad range of uses. Unlike Plan Development approvals, a Master Plan doesn't require a return trip before the Planning Commission, if the request stated is within the boundaries of the Master Plan.  In MP-I there is an independent general code by which restrictions are set; like, building height, perimeter buffers, external access points and minimum setbacks.   -- Approved, Unanimous
