PROCLAMATION: Water Conservation Month Accepting:  Terri Behling, Senior Government Affairs Manager Charlotte, DeSoto, Manatee and Sarasota Counties

Southwest Florida Water Management district -- Behling thanked Mayor Bryant and  the City of Palmetto for making April, Water Conservation Month.

3.  PUBLIC HEARING:  ORDINANCE NO. 2012-05 (Attorney Barnebey)

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AMENDING THE CODE OF ORDINANCES TO REVISE PROVISIONS RELATED TO CRIMINAL PUBLIC NUISANCES AND THE CRIMINAL NUISANCE ABATEMENT BOARD; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

Open the public hearing.  Close the public hearing after public comment.

 Action Request: Motion to adopt Ordinance No. 2012-05.  Adds provision to go before Board before taking action. -- Approved, Unanimous, Smith absent.

4.  PUBLIC HEARING:  ORDINANCE NO. 2012-06 (Attorney Barnebey)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA; PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR REDISTRICTING OF VOTING WARDS; ADDING SECTION 12-13 OF THE CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

Open the public hearing.  Close the public hearing after public comment.

Action Request: Motion to adopt Ordinance No. 2012-06.  -- Approved, 3 - 1, Cornwell dissent, Smith absent.

5.  FIRST READ:  ORDINANCE NO. 2012-02 (J. Freeman)

AN ORDINANCE OF THE CITY OF PALMETTO AMENDING CHAPTER 22, PERSONNEL, ARTICLE IV, GENERAL EMPLOYEES' RETIREMENT SYSTEM, OF THE CODE OF ORDINANCES OF THE CITY OF PALMETTO; AMENDING SECTION 22-81, DEFINITIONS; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY OF PROVISIONS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.

Action Request Motion to schedule a public hearing for Ordinance No. 2012-02 for April 2, 2012. Approved, Unanimous, Smith absent.

 6.  AWARD OF PROPOSAL FOR THE SUTTON PARK RENOVATION PROJECT

Action Request: Recommendation of Award of Proposal for the Sutton Park renovation project to Stellar Development; approve and authorize the mayor to execute a Construction Agreement with Stellar Development in an amount not to exceed $735,346; and approve, if necessary, a 10% contingency for the project with Stellar Development not to exceed $73,500. -- No vote.

7.  BASEBALL FIELD UPDATE -- No report, reschedule meeting with BOCC.

8.  ASR WELL UPDATE -- No report, Water Management on vacation.

9.  DEPARTMENT HEADS’ COMMENTS -- Freeman will check on grant. There are four charging stations at City Hall. Two new electric vehicles, a Chevy van and a Chevy Volt will be parked near front at charging stations. 

10.  MAYOR’S REPORT  -- Bryant said Council of Governments will be April 3. Subjects to discuss will be 7th Street light, and Desoto bridge emergency plan.


11. COMMISSIONERS’ COMMENTS  -- Varnadore wants to check to see Monument for forgotten soldiers is going forward. Williams wants to find out who responds to "open burn" in city limits.
