CONSENT AGENDA -- PUBLIC HEARING APPLICATIONS (CONSENT) - The following items have no objections from County staff and the applicants concur with the staff recommendations. After opening the public hearing, the Chairman may determine if anyone in the audience or on the Commission has comments or opposition to any of these items. If so, the Chairman may place that item in the regular agenda for further consideration. The remaining items may be acted on in total by using the recommended motion.

4. ORDINANCE 11-41 – LAND DEVELOPMENT CODE TEXT MASTER PLANNED INSTITUTIONAL ZONING DISTRICT

An Ordinance of the Board of County Commissioners of Manatee County, Florida, regarding land development; amending the Manatee County Land Development Code to create a new Zoning District – ”Master Planned – Institutional" (MP-I) – and amending the Land Development Code to effectuate that zoning district; including amendments to Chapter 2 – Definitions; Chapter 6 – zoning districts; Figure 6-1, use chart; Figure 6-2, schedule of area, height, bulk and placement regulations; and any other revisions deemed necessary or appropriate during the public hearing process; providing for codification; providing for severability; and providing an effective date. 

Attorney Caleb Grimes, representing IMG Academies (the applicant), gave a brief IMG history, then explained why they requested a land development code rewrite for the 111 acre purchased for expansion, currently zoned agriculture. Grimes said he wanted to make the next added parcel work for general use "we want it flexible." He said there wasn't a zoning district that does this and suggested a "straight zoning category" with a broad range of uses. Grimes added that the Master Plan outlines how it will be done. The rezoning request is for the complete campus, excluding the golf course and condominiums. 

One of the requests is to extend the height of code to 85 feet from the current 35. Commissioner Marilyn Stasica suggested the applicant consider expanding the "open space" if raising the allotted height. Grimes said "we need the flexibility of height." He also reminded the commission that approvals would be limited to a list of "range of uses." The Principal Planner, Katie LaBarr said, "If you have a list of range of uses, it will require a modification on the master plan," adding "it's like plan development without calling it plan development." -- motion to approve -- Recommended, 6 to 1, Stasica  dissent.  

5. PDC-11-16(Z)(G) – 8154 LLC/BAYSIDE PET RESORT

An Ordinance of the Board of County Commissioners of Manatee County, Florida, regarding land development, amending the official zoning atlas (Ordinance 90-01, the Manatee County Land Development Code), relating to zoning within the unincorporated area; providing for the rezoning of approximately 3.24± acres on the west side of U.S. 41, at 8154 N. Tamiami Trail, Bradenton from GC/AI (General Commercial/Airport Impact Overlay) and RSF-3 (Residential Single-Family – 3 Dwelling Units per Gross Acre) to the PDC/AI (Planned Development Commercial/Airport Impact Overlay) and PDC (Planned Development Commercial) zoning district; approve a General Development Plan for use of an existing commercial building for a kennel; subject to stipulations as conditions of approval; setting forth findings; providing a legal description; providing for severability, and providing an effective date.

Misty Servia, Planning Department Manager for King Engineering, representing Bayside Pet Resort, seeks to completely revamp what was the Rip Van Winkle Bowling Alley. The seven-year vacant building and land would have millions spent equipping the building with a state of the art 161-kennel facility, with sound suppressing interior and plenty of landscape. Servia says the owners will be creating many jobs and spice up the southern gateway into Manatee County. 

The 21,109 sq. ft. building sits west of Hwy 41, between McDonalds to the south and The Budget Inn, to the north. It will have 44 percent open space, aligns with all of Comp Plan requirements and will be using what was the existing building, Servia says, "will help reduce the sprawl." Planning Manager, Kathleen Thompson, confirmed there were no wells, and said, "there was no requirements for storm water." Staff recommends approval. -- Recommended Unanimous   

6. Z-11-08 – MANATEE MEMORIAL HOSPITAL FOUNDATION, INC./MANATEE MEMORIAL HOSPITAL REZONE

Sharon Tarman, Planner (DTS #20110272)

An Ordinance of the Board of County Commissioners of Manatee County, Florida, amending the official zoning atlas (Ordinance No. 90-01, the Manatee County Land Development Code), relating to zoning within the unincorporated area; providing for the rezoning of approximately 0.24 acres at 604 46th Street West, Bradenton from the RSF-4.5 (Residential 4.5 dwelling units per gross acre) to the GC (General Commercial) zoning district; setting forth findings; providing a legal description; providing for severability, and providing an effective date.

Attorney Caleb Grimes returns to represent the applicant to change zoning for a parking lot behind the store. Proceeds from the store go to helping student nurses who are struggling to get through school and other charity needs. The rezoning would only allow a parking lot. Planner, Sharon Tarman, says it is compatible with planning and that there are no objections. -- Recommended, Unanimous.
