Lincoln Memorial Academy Loses Appeal

PALMETTO – On Wednesday, former Palmetto-based district charter school Lincoln Memorial Academy suffered another loss as Florida’s First District Court of Appeals affirmed a previous ruling approving the School Board of Manatee County’s decision to terminate its charter school contract.

In affirming the initial ruling by Chief Administrative Law Judge Robert Cohen, the First District Court of Appeal stated that the previous ruling was "supported by competent, substantial evidence, and we find no merit in Appellant’s arguments.“

Judge Cohen issued his original 95-page ruling upholding the School Board’s decision to terminate LMA, Inc.’s charter on September 27, 2019. In February 2020, Judge Cohen ordered Lincoln Memorial, Inc. to cover more than $297,000 of legal fees and expenses used by the school district to litigate the dispute.

"Our focus as a school district as it pertains to Lincoln Memorial Academy is on its future and the success of its students,“ Superintendent Cynthia Saunders said in a press release. "We are open to working with members of our community who want to share and participate in the school’s success.“
