Lawsuits meant to chill free speech should concern all of us

In the wake of the last election, something unusual happened in Manatee. The underfunded, grassroots candidates — the ones without the flood of glossy mailers and professionally financed sign campaigns — won.

And soon after, a series of lawsuits began.

Community voices, including The Blue Puppet in Manatee (Kevin-Kyle Kaczynski Von Oswald XVII), a political action committee run by Betsy Benac; The Bradenton Times; former commissioner Joe McClash; and even The Sarasota Phoenix and Jon Susce, found themselves drawn into litigation. The cases are being pursued by the same out-of-area attorney. The financial backing and motivations behind these actions are not publicly established and cannot be stated as fact, but the timing is difficult to ignore.

Defending a lawsuit is expensive, exhausting, and time-consuming. Legal counsel typically advises clients to limit public comment while cases are pending. The practical effect is that some of the very people who helped inform voters in the last election are now largely silent as another election approaches.

Regardless of where one stands politically, that pattern should concern anyone who values open civic debate. Elections are decided at the ballot box. If the response to losing political influence is prolonged legal warfare that chills speech, the public has a right to ask whether our democratic process is being respected in spirit as well as in law.

Voters deserve robust debate — not silence enforced by litigation.

    "Thank you, Liz, for shining a light on this. As someone who has spent decades fighting for the soul of Manatee County, it is deeply concerning to see the legal system used as a 'muzzle' for community voices. Our residents deserve a transparent process where ideas are debated in the town square, not suppressed in a courtroom. We need to protect the right of every citizen to speak up without the fear of being sued into silence."
