Manatee County Planning Commission Agenda Results: 3/14/13

BRADENTON -- At Thursday's Manatee County Planning Commission meeting, commissioners voted to recommend two applications against strong public opposition. The 50-unit expansion of Rye Road LLC and a seven-unit expansion of Raven Wood, both of which are in Northeast Manatee County near Grayhawk Landing, were met by neighboring residents concerned over density and flooding issues.

CONSENT AGENDA

PUBLIC HEARING APPLICATIONS (CONSENT) - The following items have no objections from County staff and the applicants concur with the staff recommendations. After opening the public hearing, the Chairman may determine if anyone in the audience or on the Commission has comments or opposition to any of these items. If so, the Chairman may place that item in the regular agenda for further consideration. The remaining items may be acted on in total by using the recommended motion.

1. PDR12-12(Z)(P) – EXTENDED INVESTMENTS HOLDINGS, LLC/SOUTHERN OAKS DTS#20120374

An Ordinance of Manatee County, Florida, regarding land development, amending the official zoning atlas (Ordinance 90-01, the Manatee County Land Development Code), relating to zoning within the unincorporated area; providing for a rezone of approximately 70.70 acres. Located west of Rye Road and approximately 2 miles + south of S.R. 675, specifically at 2505, 2757, 2905 and 3115 North Rye Road, Parrish, FL, from A/NCO (Agriculture/North Central Overlay) zoning district to PDR/NCO (Planned Development Residential/North Central Overlay) zoning district; approve a Preliminary Site Plan for 139 residential units to be known as Southern Oaks; subject to stipulations as conditions of approval; setting forth findings; providing a legal description; providing for severability, and providing an effective date. Recommended for approval, unanimous without discussion 

2. PDR-05-53(P)(R) – RAVEN CREST (DTS#20120414)

An Ordinance of the Board of County Commissioners of Manatee County, Florida, regarding land development, approving a Revised Preliminary Site Plan to:
• Increase the total number of lots from 31 to 38 lots for single-family detached residences.
• Realign interior roadways within the subdivision;
• Eliminate one inter-neighborhood tie;
• Modify floodplain compensation area and stormwater ponds. Recommended for approval, unanimous (full story)

The 18.00± acre site is in the PDR (Planned Development Residential) zoning district. The site is approximately two miles north of SR 64 on the south side of Upper Manatee River Road, approximately ½ mile east of the curve at 11708,11710 and 11718 Upper Manatee River Road, Bradenton; subject to stipulations as conditions of approval; setting forth findings; providing for severability; providing a legal description, and providing an effective date.

3. PDR 11-09 (Z)(P)(R) – RYE ROAD LLC/RYE ROAD SUBDIVISION – B00000069 DTS#20120429

An Ordinance of the Board of County Commissioners of Manatee County, Florida, regarding land development, amending the official zoning atlas (Ordinance No. 90-01, the Manatee County Land Development Code) relating to zoning within the unincorporated area; providing for the rezoning of approximately 23.4 acres on the north side of Waterline Road from A (General Agriculture, one dwelling unit per five acres) to the PDR (Planned Development Residential) zoning district; approving a Revised Preliminary Site Plan to:
• Add ±23.4 acres to a previously approved Subdivision ((Rye Road Subdivision ±35.26) acres for a total of ±58.45 acres;
• Increase the number of lots for single-family detached residences from 102 to 152;
• Realign interior roadways within the subdivision;
• Add second means of access connecting Waterline Road;
subject to stipulations as conditions of approval; setting forth findings; providing for severability; providing a legal description, and providing an effective date.

Commissioner Delesline said that he would like to at least see a bit more buffer on Water Line Road to "get the houses back a hair from the road." Joel Christian from county environmental services explained that the one-tree per 30 foot, 15-foot deep greenbelt buffer was in compliance with county code. Commissioner Belford asked whether the flooding on Water Line was something that could be contained or if it was "something you just can't win?" Staff said that the public meeting was the first they had heard of the problem and had not had a chance to coordinate with highway services. Recommended for approval 6-1, Delesline dissenting over concerns with the buffer.
