PALMETTO – At Monday's meeting, Palmetto City Commissioners confirmed the Mayor's appointments to keep the same officers to head the city's departments. Commissioners voted to approve the Blackstone Park expansion site for new Little League fields and voted to deny annexation of a .6828 acre property at 529 20th Street West.

 Action Request: Motion to confirm the appointments of the Appointed Officials as set forth by the Mayor in the January 7, 2013 agenda memorandum and authorize her to execute the letter with Blalock Walters. -- Reappointed all of the same department heads. --  Approved, Unanimous

Action Request: After finding the request to be consistent with Chapter 163, Florida Statues, and consistent with other provisions of the City of Palmetto Comprehensive Plan, I move to approve Ordinance 2012-15.

6. PUBLIC HEARING: ORDINANCE NO. 2012-16 (L. Lyn-Carried forward from the 4:30 p.m. workshop)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; REZONING APPROXIMATELY 0.6828 ACRES OF PROPERTY GENERALLY LOCATED AT 529 20th STREET WEST, PALMETTO, FROM GENERAL COMMERCIAL (GC) (COUNTY) TO DUPLEX AND SINGLE FAMILY RESIDENTIAL (RM-5) (CITY); PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE (Z-2012-03 Applicant: Art Rentals, LLC. Action Request: After considering the evidence presented and finding the request to be consistent with the City of Palmetto Comprehensive Plan, I move to approve Ordinance 2012-16.

7. BLACKSTONE PARK EXPANSION SITE PLAN APPROVAL

(L. Lyn-Carried forward from the 4:30 workshop)

This is a request for site plan approval for an expansion at Blackstone Park of three regulation little League fields, parking lot, press box/concession facility, storm water management area, bleachers, sidewalks, lighting, irrigation, etc.

Action Request: Motion to approve the site plan as recommended by the Planning and Zoning Board. -- Approved, Unanimous

8.  PUBLIC HEARING CONDITIONAL USE PERMIT NO. 2012-08 (L. Lyn)

Application by Old Florida Investments, Inc., located at 607 & 609 11th Street West and 608 & 610 11th Street West.

Open the public hearing.  Close the public hearing after public comment.

Action Request Based upon the evidence presented at the public hearing and finding the request to be consistent with the City of Palmetto Comprehensive Plan and Code of Ordinances herein, I move to approve CU 2012-08 for the property located at 607 & 609 11th Street West with conditions 1-8, plus the additional 3 conditions for this property as provided in the staff report and approval of a waiver of the parking requirement in Section 28-78(b)(1) of the City Code of Ordinances. -- Approved, Unanimous

Action Request: Based upon the evidence presented at the public hearing and finding the request to be consistent with the City of Palmetto Comprehensive Plan and Code of Ordinances herein, I move to approve CU 2012-08 for the property located at 608 & 610 11th Street West with conditions 1-8, plus the additional 3 conditions for this property as provided in the staff report and approval of a waiver of the parking requirement in Section 28-78(b)(1) of the City Code of Ordinances. -- Approved, Unanimous

9.  PUBLIC HEARING CONDITIONAL USE PERMIT NO. 2012-09 (L. Lyn)

Application by Old Florida Investments, Inc., located at 619, 621, & 623 11th Street West and 1010 & 1012 7th Avenue West.

Open the public hearing.  Close the public hearing after public comment.

Action Request: Based upon the evidence presented at the public hearing and finding the request to be consistent with the City of Palmetto Comprehensive Plan and Code of Ordinances herein, I move to approve CU 2012-09 for farm worker housing located at 619, 621, & 623 11th Street West and 1010 & 1012 7th Avenue West subject to the stipulations contained in the staff report, and including a waiver of the parking requirement in Section 28-78(b)(1) of the City Code of Ordinances. -- Approved, Unanimous

10.  1st READ: ORDINANCE NO. 2013-01 (M. Barnebey)

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AMENDING THE PALMETTO CODE OF ORDINANCES, CHAPTER 26, SUBDIVISIONS; PROVIDING FOR AMENDED SUBDIVISION REGULATIONS; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

Action Request: Motion to schedule a public hearing for January 28, 2013 at 7:00 p.m. or as soon thereafter as same can be heard in these chambers. Motion to continue to January 28, -- Approved, Unanimous

11.  SELECTION OF VICE MAYOR

Action Request: Motion to nominate a Vice Mayor. --  Commissioner Smith nominated Varnadore, -- Approved, Unanimous

Recess the City Commission meeting to open the January 7, 2013 CRA Board meeting.

3.  CRA DIRECTOR’S COMMENTS -- Director Burton said an additional of $250,000 to the BP Recovery Act money will be matched with SWFTWMD Funds. This is connected to the County's Estuary Funds -- Request to be approved when Regular meeting reopens. Smith concerns were whether Commissioner Chappie's letter about controlling the funds. Smith requested a letter to confirm the allotted money does go to the City.

 

Multi-cultural event 1/19: Mayor Bryant suggested more conversation on development protocols, empty buildings, food carts, etc. for vendors. She also suggested putting the item on the 1/28 agenda

12. BASEBALL FIELD UPDATE -- Ready

13. ASR WELL UPDATE -- Public Works Director, Allen Tusing -- Meeting with engineers Tuesday. No more noise complaints.

14. DEPARTMENT HEADS’ COMMENTS -- City Clerk, Jim Freeman, Thanks for reappointment, then made Motion to accept $250,000 for park from BP -- Varnadore wants to wait on the amount. Will be put on future agenda. Williams seconds modification to the motion. -- Approved, Unanimous

15. MAYOR’S REPORT -- Movie in the park is happening. Mayor ask each commissioner to sign up to volunteer. Personally thanked all of the sponsors for the Christmas Party and the cooks.-- Fair starts 17th to the 27th. -- MPO Meeting, The green Bridge funding has fallen off. Manatee voted to remove the PD&E, $5.6 mil. -- now it will be a Feasibility Study. "I have been upset about the outcome and invite input by the board."  

16. COMMISSIONERS’ COMMENTS -- 

Smith -- City Att., Mr. Zirkleback volunteered, we need to get him here. -- New USF Coach needs to be recognized. He grew up here in Palmetto and played for Manatee High. 

Cornwell -- Attended meeting just before the fair -- "Live long and prosper."

Davis -- Thanks Allen for getting line clearance with FPL. Chief, more break-ins off 5th., to which Chief Wells replied, "We caught them."  

Williams -- Allen Tusing, when are the Christmas decorations coming down? Tusing "very soon" -- Chairs are broke, need replacing. -- Skate park lights shine into drivers eyes. %th Street, cars are driving into weed beds, Mayor has discussion on workshop.

Varnadore -- I think it is great the staff stayed the same -- It a show of confidence.

17. ADJOURNMENT

If any person desires to appeal any decision of the City Commission, CRA Board, or of any other Board of the City, that person will need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (FS §286.0105).
