Palmetto City Commission Agenda Results: 2/3/2014

PALMETTO -- At Monday's Palmetto City Commission meeting, members received a briefing on the timelines and procedures to CDBG (Community Development Block Grants). In other business, commissioners voted to go forward in their next meeting in the process of adopting the new FEMA Floodplain maps.

Action Request: Motion to approve the February 3, 2014 Agenda. -- Approved, Unanimous

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AUTHORIZING THE EXECUTION OF AN INTERFUND LOAN BETWEEN THE TRAILER PARK TRUST AND WATER/SEWER FUNDS; AUTHORIZING THE EXECUTION OF SUCH OTHER DOCUMENTS AS MAY BE NECESSARY TO COMPLETE THE TRANSACTIONS CONTEMPLATED HEREBY; AND PROVIDING AN EFFECTIVE DATE.

4A.  RESOLUTION 2013-42 BUDGET AMENDMENT (J. Freeman)

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AMENDING RESOLUTION NO. 2013-29, WHICH RESOLUTION ADOPTED THE BUDGET FOR FISCAL YEAR 2013-2014, AND PROVIDING FOR AN EFFECTIVE DATE.

Action Request: Motion to adopt Resolution 2013-42. -- Approved, Unanimous

5.  1st PUBLIC HEARING FOR THE CDBG GRANT (J. Freeman)

Commission will accept public comment regarding the City’s application for a Community Development Block Grant (CDBG) up to $750,000.

Open public hearing.  

Close the public hearing after public comment.

Action Request: Motion to allow staff to proceed with the application and categories of choice. --Approved, Unanimous

6.  1st READ ORDINANCE 2013-20 USE AND LOCATION OF OUTDOOR VENDING MACHINES 

(M. Barnebey)

AN ORDINANCE OF THE CITY COMMISSION FOR THE CITY OF PALMETTO, FLORIDA, AMENDING THE PALMETTO CODE OF ORDINANCES; PROVIDING FOR THE REGULATION OF THE USE AND LOCATION OF OUTDOOR VENDING MACHINES; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

Action Request: Motion to schedule Ordinance 2013-20 for a public hearing on February 24, 2014 at 7:00 p.m. or as soon thereafter as same can be heard in these chambers and direct staff to advertise for same. -- Approved, Unanimous

7.  PUBLIC HEARING ORDINANCE 2013-19 REGULATION OF DROP BOXES (M. Barnebey)

AN ORDINANCE OF THE CITY COMMISSION FOR THE CITY OF PALMETTO, FLORIDA, AMENDING THE PALMETTO CODE OF ORDINANCES; PROVIDING FOR THE REGULATION OF THE USE AND LOCATION OF DROP BOXES; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

Action Request: Motion to continue the public hearing on Ordinance 2013-19 to February 24, 2014 at 7:00 p.m. or as soon thereafter as same can be heard in these chambers. --Amending to move the date -- Approved, 3 - 2, Smith and Cornwell dissent -- Second vote was to hear the issue on June 30, 2014  -- Approved 3 - 2 Smith and  Cornwell dissent 

8.  PUBLIC HEARING ORDINANCE 2013-21 REGULATION OF THE USE AND LOCATION OF PORTABLE STORAGE CONTAINERS (M. Barnebey)

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, AMENDING THE PALMETTO CODE OF ORDINANCES; PROVIDING FOR THE REGULATION OF THE USE AND LOCATION OF PORTABLE STORAGE CONTAINERS; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

9.  PUBLIC HEARING 2013-16 PERSONNEL POLICY (M. Barnebey)

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR AMENDMENT OF THE CITY CODE OF ORDINANCES TO ADOPT A NEW PERSONNEL POLICY; PROVIDING FOR APPLICABILITY; PROVIDING FOR THE REPEAL OF PALMETTO CITY ORDINANCE 05-846; AMENDING CHAPTER 22, ARTICLE I OF THE PALMETTO CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

11. RATIFICATION OF THE THIRD ADDENDUM TO PURCHASE AND SALE AGREEMENT

(M. Barnebey)

Wells Fargo had requested to extend the closing date on the property located at 1806 5th Avenue West, Palmetto, Florida until January 31, 2014.

Action Request: Motion to ratify the Third Addendum to the Purchase and Sale Agreement with Wells Fargo for the property located at 1806 5th Avenue West, Palmetto, Florida. -- Approved, Unanimous

12.  POLICE DEPARTMENT BUILDING UPDATE -- We are in the process of approving the sq. ft. Everything is going quickly. Chief Wells also said that they would be bringing the issue of a crashed police car (not the officer's fault) before the commission to work on its replacement.

13  ASR WELL UPDATE -- There will be a report on the 24th. We got the agreement from Water Management.

14  DEPARTMENT HEADS’ COMMENTS -- Gause, We are waiting for Water Management

Williams -- When can we expect to see the noise ordinance come before us?  (Answer -- Barnabey, March 3 or 17)  

Varnadore -- What we experienced when I-75 closed down last week is the reason some residents want to move from Palmetto. They are worried about not being able to make it to the hospital when there is a problem like that.

Davis -- Good job on the Fair. I would support the Mayor sending the a letter to the MPO on the bridge issue.

Cornwell -- Recently we have had some exciting times in Palmetto.

Smith -- I will be in Tallahassee with the Black Caucus from the 10th to the 12th. Then I will be going to Pensacola.
