Palmetto City Commission Agenda Results: 6/3/2013

PALMETTO -- At Monday's Palmetto City Commission meeting, commissioners approved a rezoning of two parcels for farmworkers. In other business, the Mobile Vendors ordinance was continued until the June 17, 2013 meeting.

Call to order, followed by a Moment of Silence and the Pledge of Allegiance.

Presentation -- Paul Sharp and Hillary Jackson dropped off information from the "Early Learning Coalition" and gave Chief Wells a supply of reading books for officers to give to kids when needed. 

PROCLAMATION: -- Hurricane Awareness Month -- Commissioner Jonathan Davis presented the proclamation to City Clerk Jim Freeman.

4.  PUBLIC HEARING ORDINANCE 2013-02 MOBILE FOOD VENDORS AND TEMPORARY USES

AN ORDINANCE OF THE CITY COMMISSION FOR THE CITY OF PALMETTO, FLORIDA, AMENDING CODE OF ORDINANCES, ZONING CODE, TO PROVIDE FOR A DEFINITION OF MOBILE VENDORS; REVISING THE CURRENT TEMPORARY USE PERMIT CRITERIA AND ADDING CRITERIA FOR USE AND OPERATION OF MOBILE VENDORS, INCLUDING PUSH CARTS AND TEMPORARY VENDORS; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

Open the public hearings from April 1, 2013 and May 6, 2013.

The second public hearing on Ordinance 2013-02 will be June 17, 2013 at 7:00 p.m. or as soon thereafter as same can be heard in these chambers.

5.  PUBLIC HEARING ORDINANCE 2013-06 (L. Lyn) -- AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, PROVIDING FOR FINDINGS OF FACT; REZONING APPROXIMATELY 2.72 ACRES OF PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF 14th STREET WEST, APPROXIMATELY 200 FEET EAST OF 8th AVENUE WEST, PALMETTO (PARCEL A), FROM SINGLE FAMILY RESIDENTIAL (RS-4) TO DUPLEX AND SINGLE FAMILY RESIDENTIAL (RM-5); REZONING APPROXIMATELY 7.82 ACRES OF PROPERTY GENERALLY LOCATED BETWEEN 13th STREET WEST AND  14th STREET WEST AND ON THE SOUTH SIDE OF 13th STREET WEST, APPROXIMATELY 200 FEET EAST OF 8th AVENUE WEST, PALMETTO (PARCEL B), FROM MULTIPLE FAMILY RESIDENTIAL (RM-6) TO DUPLEX AND SINGLE FAMILY RESIDENTIAL (RM-5); PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE (Z-2012-02 Applicant: Top 3% Inc. Open the public hearing.

Mr. Henry Jones spoke to the Friday night until Sunday activities that he said include public intoxication and urination. Jones wants the conditions to quit dragging down the property value. 

Chief Wells says crime has been declining, but he agrees there is still some problems, and said that as violations are committed, arrests will be made. Wells says, "We just have to catch the offense."

Action Request: After considering the evidence presented and finding the request to be consistent with the City of Palmetto Comprehensive Plan, I move to approve Ordinance 2013-06. -- Approved, 4 to 1, Smith dissent.

(Smith felt more focus needed to be applied to citizen Henry Jones'concerns).

6.  PUBLIC HEARING CONDITIONAL USE PERMIT NO. 2012-10 (L. Lyn)

Application by Top 3% Inc., located at 500-706 14th Street West and 501-704 13th Street West.

Open the public hearing. 

Close the public hearing after public comment.

Action Request: Motion to approve Conditional Use Permit 2012-10 for farm worker housing with the conditions as recommended by the Planning and Zoning Board. -- Approved, Unanimous (stipulations that 50 percent be farmworkers).

9.  DEPARTMENT HEADS’ COMMENTS -- 

-- Clerk Jim Freeman -- Budget is coming up, we will have first workshop on July 29, then on 31 and again on August 5 and the 19. 

-- Chief Wells -- Numbers are in for the Mayor: two year, total crime in Palmetto experienced a 38 percent reduction, and the census per 100K, crime was down 27.4 percent. Chief well wanted to thank the mayor for all of the tools to make that happen.

10.  MAYOR’S REPORT -- Mayor Bryant discussed how job description and administrative policy changes must be approved by commissioners (that is the ones that deal with budget changes). 

11.  COMMISSIONERS’ COMMENTS -- 

Willliams -- Asked Tusing (Public Works) if from 13th and Riverside to the railroad tracks, there was easement on the riverside side. Tusing said it was either easement or right-of-way.
