Palmetto City Commission Agenda Results: September 22, 2014

PALMETTO — At Monday night's meeting, commissioners concluded discussions and the adoption for their FY 2015 budget. They also adopted Resolution 2014-23, a Mental Health Bill supporting the Helping Families in Mental Health Crisis Act (HR 3717). In other business, the commission adopted Ordinance 2014-10, restricting property use for "pain clinics," and voted to approve Ordinance 2014-11, setting standards for medical marijuana dispensaries.

Open the public hearing to discuss the final millage rate and final FY 2015 budget.

•Discuss the percentage increase/decrease in proposed tentative millage over rolled back rate

•Discuss the specific purposes for which ad valorem revenues are being increased/decreased

•Discuss proposed tentative budget

•Public Comment

Close the public hearing after public comment.

A.  RESOLUTION NO. 2014-19 (to be read in its entirety)

A RESOLUTION OF THE CITY OF PALMETTO OF MANATEE COUNTY, FLORIDA, ADOPTING THE FINAL LEVYING OF AD VALOREM TAXES FOR THE CITY OF PALMETTO FOR FISCAL YEAR 2015; AND PROVIDING AN EFFECTIVE DATE.

Action Request: Motion to adopt Resolution 2014-19. -- Commissioners voted to adopt the Ad Valorem Tax to 5.7171 per $1,000 of taxable value which is 2.29 percent greater than the rolled-backrate of 5.5889. The taxable value of the City for the FY 2015 budget is $682,858,047 which represents a increase of 4.04 percent compared to the prior year. -- Approved, Unanimous

B.  RESOLUTION NO. 2014-20 (to be read in its entirety)

A RESOLUTION OF THE CITY OF PALMETTO OF MANATEE COUNTY, FLORIDA, ADOPTING THE FINAL BUDGET FOR FISCAL YEAR 2015; AND PROVIDING FOR AN EFFECTIVE DATE.

5.  RESOLUTION 2014-23 MENTAL HEALTH BILL (Mayor Bryant)

A RESOLUTION OF THE CITY OF PALMETTO, FLORIDA, SUPPORTING THE HELPING FAMILIES IN MENTAL HEALTH CRISIS ACT (H.R. 3717) BILL CO-SPONSORED BY U.S. REPRESENTATIVE VERN BUCHANAN AND REPRESENTATIVE TIM MURPHY OF PENNSYLVANIA.

6.  1st READ ORDINANCE 2014-15 NOISE CITATION (M. Barnebey)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, REGULATING AND PROHIBITING THE EMISSION OF HARMFUL NOISE; AMENDING SECTION 5-8, INCLUSIVE, OF CHAPTER 5 OF THE CITY OF PALMETTO CODE OF ORDINANCES; PROVIDING FOR ADDITIONAL CIVIL PENALTIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

Action Request: Motion to schedule a public hearing on Ordinance 2014-15 for October 20, 2014 at 7:00 p.m. or as soon thereafter as same can be heard and direct staff to advertise for same. -- Approved, Unanimous

7.  2nd PUBLIC HEARING ORDINANCE 2014-11 MARIJUANA DISPENSARIES (M. Barnebey)

AN ORDINANCE OF THE CITY OF PALMETTO, FLORIDA, AFFECTING THE USE OF LAND IN THE CITY OF PALMETTO; PROVIDING FOR AMENDMENTS TO THE ZONING CODE RELATED TO MEDICAL MARIJUANA DISPENSARIES; SETTING FORTH DEFINITIONS, STANDARDS AND REGULATIONS FOR MEDICAL MARIJUANA DISPENSARIES; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

Open the public hearing.  

Close the public hearing.

Action Request: Motion to adopt Ordinance 2014-11. -- Approved, 3-2,  -- Smith and Cornwell dissenting.

-- Smith was opposed to any vote until the measure passes at the state level.

11.  REGATTA BOAT FESTIVAL FEBRUARY 2015 UPDATE -- Chief Wells said they had their first meeting with the staff in Bradenton and are still working out the road configuration for the bridge. They are meeting again soon.

14.  MAYOR’S REPORT -- Mayor Shirley Groover Bryant said she was happy everything went so well at the groundbreaking for the Riverside Drive boat ramp.

15.  COMMISSIONERS’ COMMENTS -- 

Williams said he was recently nominated to be a member in a legislative committee that focuses on energy and the environment. The committee is looking for recommended issues and from six choices submitted the mayor suggested the water quality and storm water be the two that Palmetto recommends.
